Being Innocent Doesn't Assure Protection
Substantiating an innocent spouse claim on a joint tax return is not easy. There are several conditions the spouse must meet, and even if the claim is substantiated, the spouse may still be required to pay at least a portion of the tax burden. Burden of proof is on the innocent spouse, not the IRS.
